Terms and Conditions
Welcome! This page outlines the terms and conditions for working with Rebecca Flint (ABN 55 467 115 900), trading as Rebecca Mountford Design. By engaging my services, you agree to the terms below. These are designed to protect both of us and ensure a smooth, enjoyable creative experience.
1. Engagement
When you approve a quote or proposal, you’re engaging Rebecca Flint (“the Designer”) to provide creative, design, branding, marketing, or advertising services (“the Services”) as outlined in the agreed scope.
Each approved quote or proposal forms a binding contract between us.
2. Fees, Quotes, and Payment
All quotes are valid for 14 days.
Work begins once approval is received in writing (email is fine).
My hourly rate is $250, billed in 15-minute increments.
Express or after-hours work (booked after 3:30pm for next-day delivery, or work after 6pm/weekends) may be charged at 1.5–2x the standard rate.
Payment terms:
A 40% non-refundable deposit is required to confirm your booking. The balance is due before final files are released or as otherwise outlined in your quote.
All “Book Me For A Day/Half Day/Hour” products require full payment upon booking.
All invoices are payable within 7 days of issue, with the exception of deposit invoices, which are due upon receipt to ensure your work can begin immediately.
Late payments attract a $30 per week admin fee until paid.
As I’m not registered for GST, no GST is added to my invoices.
3. Revisions, Scope Changes, and Delays
Your quote includes one round of reasonable revisions, unless otherwise stated.
Any additional rounds, creative changes, or rework caused by delayed feedback or missing content will be billed at my hourly rate.
If feedback or assets aren’t provided by agreed deadlines, the project may be placed on hold and a $100 per day holding fee may apply.
4. Intellectual Property and Usage
You’re responsible for ensuring all content you supply (like images, text, fonts or logos) is owned by you or properly licensed.
I retain ownership of all concepts, working files, and editable source files (for example: InDesign, Illustrator, Photoshop, or Canva).
Once full payment is received, you receive a non-exclusive licence to use the final approved deliverables for their intended purpose.
If you’d like to own the working or source files, we can discuss a buyout fee.
I also reserve the right to share completed projects in my portfolio, social channels, or award submissions, unless we’ve agreed otherwise in writing.
5. Approvals and Responsibilities
I deliver all work with professional care and attention to detail.
It’s your responsibility to review proofs and ensure everything is correct — including spelling, grammar, images, and compliance with advertising/industry standards.
Once approved in writing, I’m not responsible for any errors or omissions found later.
6. Confidentiality and Privacy
All confidential or sensitive information shared during our work together stays private. I comply with the Privacy Act 1988 (Cth) in handling any personal or business data.
7. Limitation of Liability
To the extent permitted by law:
My liability is limited to re-supplying services or refunding the portion of fees for the affected work.
I’m not liable for indirect or consequential loss, such as loss of profit, opportunity, or data.
Your rights under the Australian Consumer Law remain protected and are not excluded by this agreement.
8. Termination
Either of us may end the project in writing if:
Payment is overdue by more than 14 days;
A serious breach occurs and isn’t fixed within 7 days of notice; or
Either party becomes insolvent or stops trading.
If the project ends early, you’ll be invoiced for all work completed up to that point. Files or deliverables may be withheld until payment is received.
9. Governing Law
This agreement is governed by the laws of Queensland, Australia, and both parties agree to submit to the jurisdiction of the Queensland courts.
