These terms and conditions (the "Terms and Conditions") govern the use of www.rebeccaflint.com (the "Site"). This Site is owned and operated by Rebecca Flint. This Site is a coaching, brand and graphic design site.

By using this Site, and any other Sites owned by Rebecca Flint, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Property.

All content published and made available on our Site or any other sites owned by Rebecca Flint, is the property of Rebecca Flint and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Accounts

When you create an account on our Site(s), you agree to the following:

1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Sale of Goods And Services

These Terms and Conditions govern the sale of goods and services available on our Site.

The following goods and services are available on our Site(s):

  • Coaching; and

  • Done-for-you branding and graphic design services.

  • Affiliate products and services

  • Other services and products from time to time

The services will be paid for in full when the services are ordered.

These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Subscriptions/Memberships

Your subscription automatically renews and you will be automatically billed until we receive notification that you want to cancel the subscription. You can also cancel your own subscription - see below.

The minimum term for all subscription services is 3 months. Thereafter, you can pause or cancel anytime. You can upgrade your membership or downgrade your membership at any time though.

To manage, pause, upgrade or cancel your subscription, please follow these steps:

  • Login to your Training & Resource membership Portal

  • In the hamburger menu click “Customer Portal” and you can manage your membership there

Platinum Level - Private Coaching.

This membership level entitles you to one 30-minute private coaching session each month. Please note that sessions do not accumulate and must be booked within the month they are due. If you cancel a session, you may reschedule it within the same month. However, failure to notify us of a cancellation or to reschedule will result in the forfeiture of that month’s session.

Payment Methods

We accept the following payment methods on our Site:

  • Credit Card;

  • PayPal; and

  •  Apple Pay

  • We may add other payment methods from time to time

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Tax and GST - as at 1/7/2023

At present, Rebecca Flint is not required to charge, collect or pay GST in Australia, and as such your membership will reflect this showing a $0 GST component. Should this change in the future, your membership will increase to cover the cost of GST, and this will be reflected on your invoices.

Refunds

Due to the nature and delivery of the content and templates inside of The Canva Society membership and; becuase the program is month-by-month refunds are not permitted. You are welcome to stay a member for the duration of the time purchased (the rest of the month), however no pro-rated or full refunds will be provided for any reason. If you are unable to continue with your membership for any reason, after the initial 3 month min term is served, you are welcome to cancel your membership via the customer portal.

Refunds for Services

All services sold on our Site are non-refundable.

Consumer Protection Law

Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Links to Other Websites

Our Site contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.

Limitation of Liability.

Rebecca Flint and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity.

Except where prohibited by law, by using this Site you indemnify and hold harmless Rebecca Flint and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the State of Queensland.

Severability.

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site(s).

Mobimag Course - T&Cs:

We will gladly refund your money up to 14 days after a course starting if you have fully completed all the work up to that date and don’t completely love the course. We will NOT provide refunds for any request that comes more than 14 days following the date of Module 0 release. After day 14, all payments are non-refundable and you are responsible for full payment of the fees for the program regardless of whether you complete the program.

We will not refund for change of mind, or not being able to attend, or for you having technical difficulties or loss of internet.

You will have one full year’s access to your course to do at a later date should you not be able to attend for whatever reason.

Book me for a day - T&Cs:

Project T&Cs: The range of services covered under day rates may vary depending on the nature of the project. For Half Day Rates, all the necessary work will be accomplished within a 4-hour duration. For Full Day Rates, the entire project will be completed within an 8-hour timeframe, which includes a 1-hour lunch break. An optional 60-minute prep call is included in all Day Rates, and it must be scheduled at least 48 hours before the project date.

Rebecca Flint and the Client agree to discuss the specifics of the work at least 48 hours before the scheduled Day Rate. Rebecca Flint will exert their best efforts to fulfill as many of the Client's requirements within the given timeframe. The Client understands that Rebecca Flint cannot guarantee the exact time needed for each task and, as such, may not be able to fulfill all of the Client's requests within the set timeframe.

Payment: All services must be paid in full and cleared, 24 hours prior to the job starting.

Cancellation + Rescheduling Policy: We understand that circumstances may change, and you may need to cancel or reschedule your scheduled Book Me For A Day or Half Day session.

If you need to cancel, please provide us with at least 14 days' notice, and we'll refund 50% of your payment. If you provide less than 14 days' notice, no refund will be issued.

If you need to reschedule your Book Me For A Day or Half Day session, you can choose a new date within 30 days, depending on our availability. Please give us at least 14 days' notice for rescheduling. If you provide less than 14 days' notice, we'll charge a $200 rescheduling fee.

In the rare event that we need to cancel your Day Rate session, we'll give you the option to either book a new date or receive a full refund. If we need to reschedule the project, we won't charge you a rescheduling fee.

Support after your scheduled session: Rebecca will be available to provide support to the Client via Voxer for 14 days after the project date, and for up to 2 hours of support for a full day booking, and one hour for a half day booking. The Client will receive a 10% discount on any additional day rates booked in the future. This discount does not apply to any other products, courses or services, or the hourly rates.

Confidentiality and Privacy

Rebeccaflint.com respects the privacy of its clients and will not disclose any information You provide except as set forth in this Agreement. As a condition of participating in any Course or membership, you hereby agree to respect the privacy of other Program participants and to respect Rebeccaflint.com’s confidential information. Specifically, you shall not share any information provided by other Program participants outside of the bounds of the Program unless you receive express written permission from such other participant to share the information. Similarly, the content of the Program contains Rebeccaflint.com’s proprietary methods, processes, forms, templates, and other information. You hereby agree not to share the information provided to You in the Course with anyone other thanRebeccaflint.com, it’s owners and employees, and other Program participants.
